1. ACCEPTANCE OF TERMS

These Terms of Service ("Terms," "Agreement") constitute a legally binding agreement between you ("you," "your," "User") and Qaswa Connect ("we," "us," "our," "Company") governing your access to and use of the Qaswa Connect mobile application ("App") and all related services, features, content, and functionality (collectively, the "Services").

BY CREATING AN ACCOUNT, ACCESSING, OR USING THE APP, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS AND OUR PRIVACY POLICY. If you do not agree to these Terms, you are not authorized to use the App and must immediately cease all use.

These Terms apply to all users of the App, including but not limited to individual users, masjid administrators, volunteers, and donors.

2. DESCRIPTION OF SERVICE

Qaswa Connect is a mobile application platform designed to connect Muslims with their local masjid (mosque) communities. The App provides the following features and services:

  • Discovery and connection with local masjids

  • Accurate prayer times and iqamah schedules

  • Community events, announcements, and calendar

  • Khutbah (sermon) library with video and audio recordings

  • Secure donation processing for one-time and recurring contributions

  • Volunteer opportunity listings and sign-ups

  • Gender-specific and youth group chat functionality

  • Ramadan features including iftar/suhoor schedules

  • Community posts, comments, and social engagement

  • Masjid administration tools for authorized users

3. ELIGIBILITY AND ACCOUNT REQUIREMENTS

3.1 Age Requirements

You must be at least 13 years of age to create an account and use the App. If you are under 18 years of age, you represent that you have obtained permission from your parent or legal guardian to use the App, and your parent or guardian agrees to be bound by these Terms on your behalf.

Users under 13 are strictly prohibited from using the App. If we discover that a user is under 13, we will immediately terminate their account and delete their personal information in accordance with applicable law.

3.2 Account Registration

To access certain features, you must create an account. You agree to:

  • Provide accurate, current, and complete information during registration

  • Maintain and promptly update your account information to keep it accurate and complete

  • Maintain the confidentiality of your password and account credentials

  • Notify us immediately of any unauthorized access to or use of your account

  • Accept full responsibility for all activities that occur under your account

  • Not share your account credentials with any third party

  • Not create multiple accounts for yourself

  • Not create an account using false or misleading information

3.3 Account Security

You are solely responsible for maintaining the security of your account. We are not liable for any loss or damage arising from your failure to protect your account credentials. If you suspect any unauthorized use of your account, you must immediately notify us at support@qaswaconnect.com.

4. ACCEPTABLE USE POLICY

You agree to use the App in accordance with all applicable laws, regulations, and these Terms. You agree NOT to:

4.1 Prohibited Content

  • Post, upload, or transmit content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, hateful, or racially, ethnically, or otherwise objectionable

  • Share content that promotes violence, terrorism, or illegal activities

  • Post sexually explicit, pornographic, or inappropriate content

  • Share false, misleading, or fraudulent information

  • Post content that infringes on intellectual property rights, privacy rights, or other rights of third parties

  • Share spam, advertisements, or unsolicited promotional content without authorization

4.2 Prohibited Conduct

  • Harass, bully, stalk, threaten, or intimidate other users

  • Impersonate any person or entity, or falsely represent your affiliation with any person or entity

  • Engage in any form of discrimination based on race, ethnicity, religion, gender, age, disability, or other protected characteristics

  • Interfere with or disrupt the App, servers, or networks connected to the App

  • Attempt to gain unauthorized access to any portion of the App, other user accounts, or computer systems

  • Use automated systems (bots, scrapers, crawlers) to access or collect data from the App

  • Reverse engineer, decompile, disassemble, or attempt to derive the source code of the App

  • Remove, circumvent, disable, or interfere with security features or access controls

  • Use the App for any commercial purpose without our express written consent

  • Collect or harvest personal information of other users without their consent

4.3 Community Guidelines

The App is intended to foster a respectful, supportive Islamic community. Users are expected to:

  • Treat all users with respect and kindness

  • Engage in constructive, beneficial discussions

  • Respect the sanctity of religious spaces and content

  • Follow Islamic principles of conduct (adab) in all interactions

  • Report violations of these Terms or inappropriate content to moderators

4.4 Prohibited Fundraising Activities

Masjids and users are strictly prohibited from using the App to:

  • Conduct raffles, lotteries, contests, sweepstakes, or games of chance tied to donations

  • Offer goods, services, perks, or rewards in exchange for specific donation amounts (this does not apply to genuine charitable acknowledgments such as donor recognition plaques that have no monetary value)

  • Create investment opportunities or promise financial returns on donations

  • Engage in multi-level marketing, pyramid schemes, or referral-based donation programs

  • Solicit donations for political campaigns, candidates, or political action committees

  • Collect donations for personal use disguised as charitable purposes

  • Offer "matching" donation schemes that are not backed by legitimate, verified matching funds

  • Use donation collection for money laundering, fraud, or any illegal purpose

Violation of these prohibitions may result in immediate account suspension, termination, fund holds, and reporting to law enforcement authorities. Users who observe violations should report them immediately to support@qaswaconnect.com.

5. DONATIONS AND PROCESSING TERMS

5.1 Donation Processing and Nature of Donations

All donations are processed through Stripe, a third-party payment processor. By making a donation, you agree to Stripe's Terms of Service (stripe.com/legal) and Privacy Policy (stripe.com/privacy). We do not store your complete credit card information on our servers.

ALL DONATIONS ARE CHARITABLE CONTRIBUTIONS (GIFTS) AND NOT PURCHASES, INVESTMENTS, OR LOANS. By donating, you acknowledge that you are making a voluntary gift with no expectation of goods, services, equity, monetary return, or guarantee that funds will be used exactly as described. Donors do not receive anything of monetary value in exchange for donations. Once a donation is processed and transferred to a masjid, the masjid has sole discretion over how the funds are used within their charitable mission.

5.2 Processing and Maintenance Fee

A mandatory 2.5% processing and maintenance fee is added to all donations. This fee covers processing costs, platform maintenance, and operational expenses. This fee is separate from your donation amount and ensures that 100% of your intended donation reaches the masjid (minus Stripe's processing fees, which are approximately 2.9% + $0.30 per transaction).

Example: If you donate $100, you will be charged $102.50 ($100 donation + $2.50 processing fee). The masjid receives approximately $96.70 after Stripe's fees are deducted.

5.3 Optional Support Tip

You may choose to add an optional tip (typically 1-15%) to support Qaswa Connect's operations. This tip is entirely voluntary and goes toward platform development, maintenance, and growth. 100% of your donation amount still goes to the masjid; the tip is an additional contribution to the platform.

5.4 Recurring Donations

You may set up recurring monthly donations. By doing so, you authorize us to charge your donation method automatically each month until you cancel the recurring donation. You may cancel, pause, or modify recurring donations at any time through the App settings.

Cancellation Timing: To avoid being charged for the next billing cycle, you must cancel your recurring donation at least 48 hours before your next scheduled billing date. Cancellations made less than 48 hours before the billing date may not take effect until the following cycle. Your billing date is typically the same day of each month as your original donation.

5.5 Donation Receipts

We provide email receipts for all donations. These receipts include the donation amount, date, recipient masjid, and transaction ID. Receipts are sent to the email address associated with your account.

5.6 Tax Deductibility

Donations to qualified 501(c)(3) nonprofit organizations may be tax-deductible to the extent permitted by law. We provide donation receipts, but we do not provide tax advice. Consult a qualified tax professional regarding the deductibility of your donations. We are not responsible for determining or verifying the tax-exempt status of recipient masjids.

5.7 Refund Policy

All donations are final and non-refundable except as required by law or in cases of clear error or fraud. If you believe a donation was made in error or without your authorization, you must contact us at support@qaswaconnect.com within 30 days of the transaction.

Refund requests are evaluated on a case-by-case basis. If a refund is approved, it will be processed through the original donation method within 5-10 business days. The processing fee and any Stripe fees are non-refundable. For recurring donations, you may cancel future charges at any time, but past donations are not refundable.

5.8 Donation Disputes

If you dispute a charge with your bank or credit card company (chargeback), we reserve the right to suspend or terminate your account and pursue collection of any amounts owed. Fraudulent chargebacks may result in permanent account termination and legal action.

5.9 Payment Processing Agreement (Stripe Connect)

Donations are processed through Stripe Connect. Masjids receiving donations through the App must agree to Stripe's Connected Account Agreement (stripe.com/connect-account/legal), which governs the processing, transfer, and handling of funds.

By enabling donation processing, masjid administrators acknowledge and agree that:

  • Stripe may verify identity and organizational information before enabling payouts

  • Stripe may place holds on funds as required by their risk and compliance policies

  • Qaswa Connect may receive transaction data necessary to provide platform services

  • Chargebacks and payment disputes are subject to Stripe's dispute resolution process

  • Stripe's fees are deducted from donations before transfer to the masjid

Qaswa Connect is not responsible for actions taken by Stripe, including but not limited to account suspensions, fund holds, payout delays, or changes to their terms or fees. Disputes with Stripe must be resolved directly with Stripe.

5.10 Donation Account Holds and Fund Suspensions

We may place a hold on a masjid's donation account, suspend the ability to receive donations, and/or suspend transfer of funds already raised ("Hold") under the following circumstances:

  • We have reason to believe information provided by the masjid is false, misleading, or fraudulent

  • The masjid or its administrators have violated these Terms or applicable laws

  • We receive excessive chargeback disputes or fraud reports related to the masjid

  • We are required to comply with a court order, subpoena, or law enforcement request

  • The masjid fails to respond to verification or compliance requests within 14 days

  • We determine, in our sole discretion, that funds should be provided to a different authorized representative

  • We detect suspicious activity or patterns that may indicate money laundering or terrorism financing

During a Hold, incoming donations may continue to be collected but transfers to the masjid's bank account will be paused. We will notify the masjid administrator and provide an opportunity to resolve the issue. If unresolved after 90 days, funds may be refunded to donors or escheated (transferred to the state) as required by applicable law.

If you have questions about a Hold placed on your masjid's account, contact us at support@qaswaconnect.com with subject line "Donation Account Hold."

5.11 Donor Protection and Fraud Prevention

Qaswa Connect takes donor protection seriously. While we cannot guarantee how masjids use donated funds, we implement the following safeguards:

  • Masjid verification process before enabling donation collection

  • Monitoring for suspicious activity and unusual donation patterns

  • Investigation of fraud reports submitted by users

  • Cooperation with law enforcement in fraud investigations

  • Suspension of donation processing for masjids that violate our policies

If you believe a masjid has misused funds or engaged in fraudulent activity, report it immediately to support@qaswaconnect.com. We will investigate all reports, though resolution may be limited to suspending the masjid's account. Donors should understand that donations are made at their own risk and may not be recoverable once transferred to a masjid.

5.12 Zakat and Religious Donation Classifications

Some masjids may offer specific Islamic donation categories such as Zakat, Sadaqah, Lillah, Fidyah, Kaffarah, or other religious classifications. Qaswa Connect does not:

  • Verify that funds designated as Zakat reach Shariah-eligible recipients

  • Provide religious rulings (fatwas) on Zakat eligibility, calculation, or distribution

  • Guarantee that masjids distribute Zakat or other religious donations in accordance with Islamic law

  • Certify any donation as meeting Islamic religious requirements

  • Audit or verify how masjids categorize or use religiously designated funds

The classification of donations and their proper distribution according to Islamic principles is the sole responsibility of the recipient masjid. Donors seeking assurance that their Zakat reaches eligible recipients as defined by Shariah should consult directly with the masjid or qualified Islamic scholars before donating.

The Zakat Calculator feature provided in the App is for informational purposes only and does not constitute religious, financial, or tax advice. Users should consult qualified Islamic scholars and tax professionals for guidance on their Zakat obligations.

6. END USER LICENSE AGREEMENT (EULA) AND INTELLECTUAL PROPERTY RIGHTS

6.1 End User License Agreement

This Section 6 constitutes the End User License Agreement ("EULA") between you and Qaswa Connect for the Qaswa Connect mobile application. By downloading, installing, or using the App, you agree to be bound by the terms of this EULA.

The App is licensed, not sold, to you. Qaswa Connect reserves all rights not expressly granted to you. This license is personal to you and may not be assigned or transferred to any other person or entity.

Apple App Store Additional Terms: If you downloaded the App from Apple's App Store, you acknowledge and agree that: (a) this EULA is between you and Qaswa Connect only, and not with Apple; (b) Apple has no obligation to provide maintenance or support for the App; (c) Apple is not responsible for addressing any claims relating to the App; (d) Apple is not responsible for any third-party claims that the App infringes intellectual property rights; and (e) Apple and its subsidiaries are third-party beneficiaries of this EULA and may enforce it against you.

Google Play Store Additional Terms: If you downloaded the App from Google Play, you acknowledge that Google has no obligation or liability to you with respect to the App or this EULA.

6.2 Our Intellectual Property

The App and all content, features, and functionality (including but not limited to software, code, text, graphics, logos, icons, images, audio, video, and design) are owned by Qaswa Connect or our licensors and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property laws.

6.3 License Grant

Subject to your compliance with this EULA and our Terms of Service, Qaswa Connect grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to download, install, and use the App on a mobile device that you own or control, solely for your personal, non-commercial use in accordance with these Terms.

6.4 License Restrictions

You may not:

  • Copy, modify, distribute, sell, lease, sublicense, or transfer any part of the App

  • Reverse engineer, decompile, disassemble, or attempt to extract the source code of the App

  • Use our trademarks, logos, or branding without prior written permission

  • Create derivative works based on the App

  • Frame, mirror, or embed any part of the App on another website or application

  • Remove, alter, or obscure any copyright, trademark, or other proprietary notices

  • Use the App for any commercial purpose without our express written consent

  • Use the App in any manner that could damage, disable, or impair the App

6.5 User-Generated Content

You retain ownership of any content you create, post, or share through the App ("User Content"), including messages, comments, photos, videos, and other materials. However, by posting User Content, you grant Qaswa Connect a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to use, reproduce, distribute, display, and perform your User Content in connection with operating and providing the Services.

You represent and warrant that:

  • You own or have the necessary rights to post your User Content

  • Your User Content does not infringe on the intellectual property, privacy, or other rights of third parties

  • Your User Content complies with these Terms and applicable laws

6.6 Masjid Content

Masjids and their authorized administrators are responsible for the content they post, including events, announcements, khutbahs, and other materials. Masjids grant us a license to display and distribute their content through the App. We are not responsible for the accuracy, legality, or appropriateness of masjid-posted content.

6.7 Copyright Infringement

We respect intellectual property rights. If you believe that content on the App infringes your copyright, please contact us at support@qaswaconnect.com with:

  • Identification of the copyrighted work

  • Identification of the infringing material and its location

  • Your contact information

  • A statement that you have a good faith belief that the use is unauthorized

  • A statement that the information is accurate and you are authorized to act on behalf of the copyright owner

  • Your physical or electronic signature

7. CONTENT MODERATION AND REMOVAL

Qaswa Connect is committed to maintaining a safe and respectful community. We actively monitor and moderate user-generated content to ensure compliance with these Terms and our community guidelines.

7.1 Moderation Commitment

We commit to reviewing all reported content within 24 hours and taking appropriate action. Our moderation team reviews reports of violations and may remove content, issue warnings, suspend accounts, or take other enforcement actions as warranted.

7.2 Content We May Remove

We reserve the right to monitor, review, edit, or remove any User Content or masjid content that:

  • Violates these Terms or our community guidelines

  • Is illegal, harmful, threatening, abusive, or inappropriate

  • Infringes on third-party intellectual property, privacy, or other rights

  • Is reported by other users as objectionable

  • Contains spam, scams, or misleading information

  • We determine, in our sole discretion, is objectionable or harmful to the community

7.3 Reporting Content

Users can report objectionable content using the in-app "Report" feature available on posts, comments, messages, and profiles. Reports are reviewed by our moderation team. You may also report content directly to support@qaswaconnect.com.

7.4 Enforcement Actions

We may take action without prior notice, including but not limited to: content removal, content editing, account warnings, temporary suspension, permanent termination, and reporting to law enforcement. Removal of content does not waive our right to pursue legal remedies or terminate your account.

8. MASJID ADMINISTRATOR RESPONSIBILITIES

Users designated as masjid administrators have additional responsibilities. By registering a masjid on the platform, administrators agree to the Masjid Administrator Agreement, which supplements these Terms, and further agree to:

8.1 General Obligations

  • Provide accurate, truthful, and up-to-date information about the masjid, including name, address, contact details, and tax-exempt status

  • Manage content, events, announcements, and prayer times appropriately and accurately

  • Respond to community inquiries and support requests in a timely manner

  • Actively moderate group chats, comments, and community discussions using the tools provided

  • Review and act on content reports from community members

  • Ensure compliance with these Terms, the Masjid Administrator Agreement, and all applicable laws

8.2 Data Controller Responsibilities

As independent data controllers for personal data collected through the platform, masjid administrators agree to:

  • Process personal data only for legitimate masjid community management purposes

  • Not sell, share, or disclose user data to third parties without explicit consent

  • Respond to data access, correction, and deletion requests from community members

  • Comply with all applicable privacy and data protection laws (including GDPR, CCPA/CPRA, and state privacy laws)

  • Not use administrative access to view, collect, or export user data for purposes unrelated to masjid operations

8.3 Account Security

  • Maintain the security of all administrative accounts with strong, unique passwords

  • Not share administrator credentials with unauthorized individuals

  • Promptly revoke access for individuals who are no longer authorized

  • Notify Qaswa Connect immediately of any unauthorized access or security breach

8.4 Financial Responsibilities

Administrators who enable donation processing are solely responsible for:

  • Ensuring donations are used for the stated purposes and in compliance with tax-exempt obligations

  • Handling donor inquiries, refund requests, and disputes directly

  • Issuing donation receipts and maintaining proper financial records

  • Filing required tax returns and complying with all applicable tax laws

  • Not soliciting donations for fraudulent, illegal, or personal purposes

8.5 Liability

Masjid administrators are personally and institutionally liable for any misuse of the platform, violation of these Terms or the Masjid Administrator Agreement, or harm caused to community members through their management of the masjid. This includes liability arising from data misuse, fraudulent fundraising, content that infringes on third-party rights, or failure to moderate harmful content.

8.6 Data Handling Upon Removal

Upon removal or deactivation of a masjid account (whether voluntary or by Qaswa Connect), all administrator access will be revoked immediately. The masjid's public profile and content will be removed within 30 days. Donation transaction records will be retained as required by applicable financial regulations. Remaining personal data will be deleted or anonymized within 90 days unless retention is required by law.

8.7 Cooperation with Investigations

Masjid administrators agree to cooperate fully and promptly with any investigation by Qaswa Connect regarding compliance with these Terms. This includes, but is not limited to:

  • Providing evidence of how donations were used upon request

  • Supplying documentation supporting the legitimacy of fundraising purposes

  • Responding to inquiries within 14 days of request

  • Cooperating with law enforcement investigations if legally required

  • Providing access to relevant records and communications

Failure to cooperate with investigations may result in account suspension, termination, hold of donation funds, and reporting to appropriate authorities. We reserve the right to share information with law enforcement, regulatory agencies, or legal counsel as necessary to protect donors, users, or Qaswa Connect.

9. THIRD-PARTY SERVICES AND INTEGRATIONS

The App integrates with and relies on third-party services, including:

  • Stripe (donation processing)

  • Google Maps (location services and mapping)

  • Google Sign-In and Apple Sign-In (authentication)

  • Supabase (backend infrastructure)

  • YouTube (video hosting for khutbahs)

Your use of these third-party services is subject to their respective terms of service and privacy policies. We are not responsible for the availability, functionality, security, or practices of third-party services. We may modify, suspend, or discontinue integration with third-party services at any time without notice.

10. DISCLAIMERS AND WARRANTIES

THE APP AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND TITLE.

WE DO NOT WARRANT THAT:

  • The App will be uninterrupted, secure, or error-free

  • Defects will be corrected

  • The App is free of viruses or harmful components

  • Prayer times, masjid information, or other content is accurate, complete, or current

  • User-generated content or masjid-posted content is accurate, reliable, or appropriate

  • The App will meet your specific requirements or expectations

  • Results obtained from using the App will be reliable

You acknowledge that prayer times are calculated estimates and may not reflect actual iqamah times at your local masjid. Always verify prayer times with your masjid directly. We are not responsible for any consequences arising from reliance on prayer time information.

11. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL QASWA CONNECT, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AFFILIATES, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • Loss of profits, revenue, data, or use

  • Loss of or damage to reputation

  • Business interruption

  • Personal injury or property damage

  • Emotional distress

  • Costs of procurement of substitute goods or services

WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATED TO THESE TERMS OR YOUR USE OF THE APP SHALL NOT EXCEED THE GREATER OF: (A) ONE HUNDRED DOLLARS ($100), OR (B) THE TOTAL AMOUNT YOU PAID TO US (EXCLUDING DONATIONS TO MASJIDS) IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO LIABILITY.

Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, so the above limitations may not apply to you. In such jurisdictions, our liability is limited to the maximum extent permitted by law.

12. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless Qaswa Connect, its officers, directors, employees, agents, affiliates, licensors, and service providers from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from or related to:

  • Your use or misuse of the App

  • Your violation of these Terms

  • Your violation of any rights of third parties

  • Your User Content

  • Your breach of any representation or warranty in these Terms

  • Any dispute between you and another user or masjid

We reserve the right to assume the exclusive defense and control of any matter subject to indemnification by you, in which case you agree to cooperate with our defense of such claim.

13. TERMINATION AND SUSPENSION

13.1 Termination by You

You may terminate your account at any time by:

  • Navigating to Settings → Account → Delete Account

  • Contacting us at support@qaswaconnect.com

Account deletion is permanent after 30 days. During this grace period, you may cancel the deletion request and restore your account. After 30 days, all your personal information will be permanently deleted, except for information we are required to retain by law (e.g., donation records for tax compliance).

13.2 Termination or Suspension by Us

We may suspend, restrict, or terminate your account or access to the App immediately, without prior notice or liability, for any reason, including but not limited to:

  • Violation of these Terms or our policies

  • Illegal activity or fraud

  • Abusive, harassing, or harmful behavior

  • Misuse of the App or its features

  • Chargebacks or donation disputes

  • Extended inactivity (more than 2 years)

  • Risk to the security or integrity of the App

  • Requests from law enforcement or government authorities

13.3 Effect of Termination

Upon termination:

  • Your right to access and use the App immediately ceases

  • Your account and profile will be deactivated

  • Your User Content may be deleted (except as required by law)

  • Recurring donations will be canceled

  • Provisions of these Terms that by their nature should survive termination will survive, including intellectual property rights, disclaimers, limitations of liability, indemnification, and dispute resolution

14. DISPUTE RESOLUTION AND GOVERNING LAW

14.1 Governing Law

These Terms and any disputes arising out of or related to these Terms or the App shall be governed by and construed in accordance with the laws of the State of Oklahoma, United States, without regard to its conflict of law principles.

14.2 Informal Dispute Resolution

Before filing a formal claim, you agree to contact us at support@qaswaconnect.com to attempt to resolve the dispute informally. We will attempt to resolve the dispute through good-faith negotiations within 30 days.

14.3 Binding Arbitration

If informal resolution fails, you agree that any dispute, claim, or controversy arising out of or relating to these Terms or the App shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, except as modified by this section.

The arbitration will be conducted in Oklahoma or another mutually agreed location. The arbitrator's decision will be final and binding, and judgment may be entered in any court of competent jurisdiction.

Exceptions: Either party may seek injunctive or equitable relief in court for disputes involving intellectual property infringement, trade secrets, or violations of computer fraud and abuse laws.

14.4 Class Action Waiver

YOU AGREE THAT ANY ARBITRATION OR LEGAL PROCEEDING SHALL BE CONDUCTED ON AN INDIVIDUAL BASIS ONLY AND NOT AS A CLASS ACTION, CONSOLIDATED ACTION, OR REPRESENTATIVE ACTION. You waive any right to participate in a class action lawsuit or class-wide arbitration.

14.5 Jury Trial Waiver

YOU AND QASWA CONNECT WAIVE ANY RIGHT TO A JURY TRIAL FOR ANY DISPUTE ARISING OUT OF OR RELATED TO THESE TERMS OR THE APP.

14.6 Right to Opt Out of Arbitration

You have the right to opt out of the arbitration and class action waiver provisions in this Section 14 by sending written notice of your decision to opt out to support@qaswaconnect.com with the subject line "ARBITRATION OPT-OUT."

The opt-out notice must be sent within thirty (30) days of:

  • The effective date of these Terms, OR

  • Your first use of the App containing these arbitration provisions, whichever is later

Your opt-out notice must include your full name, email address associated with your account, and a clear statement that you wish to opt out of the arbitration agreement. If you opt out within the 30-day period, neither you nor Qaswa Connect will be bound by the arbitration provisions, but all other provisions of these Terms will remain in full force and effect.

If you do not opt out within the 30-day period, you will be bound to resolve disputes through binding arbitration in accordance with this Section 14.

15. CHANGES TO THESE TERMS

We reserve the right to modify, update, or replace these Terms at any time in our sole discretion. When we make material changes, we will:

  • Update the "Last Updated" date at the top of these Terms

  • Notify you via email (to the address associated with your account)

  • Display a prominent notice in the App

  • For material changes that adversely affect your rights, require your affirmative consent before continued use

Your continued use of the App after the effective date of updated Terms constitutes your acceptance of the changes. If you do not agree to the updated Terms, you must stop using the App and may delete your account.

It is your responsibility to review these Terms periodically. Previous versions of these Terms are available upon request.

16. MISCELLANEOUS PROVISIONS

16.1 Entire Agreement

These Terms, together with our Privacy Policy and any other legal notices or agreements published by us in the App, constitute the entire agreement between you and Qaswa Connect regarding your use of the App and supersede all prior agreements, understandings, and communications, whether written or oral.

16.2 Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.

16.3 No Waiver

Our failure to enforce any right or provision of these Terms shall not be deemed a waiver of such right or provision. Any waiver must be in writing and signed by an authorized representative of Qaswa Connect.

16.4 Assignment

You may not assign, transfer, or delegate these Terms or your rights and obligations hereunder without our prior written consent. We may assign these Terms, in whole or in part, at any time without notice or consent. These Terms shall be binding upon and inure to the benefit of the parties and their respective successors and permitted assigns.

16.5 Force Majeure

We shall not be liable for any failure or delay in performance due to causes beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, pandemics, strikes, or shortages of transportation, facilities, fuel, energy, labor, or materials.

16.6 Notices

All notices, requests, and other communications under these Terms must be in writing and will be deemed given:

  • When delivered personally

  • When sent by confirmed email to support@qaswaconnect.com (for notices to us) or to your registered email address (for notices to you)

  • Three (3) business days after being sent by certified mail, return receipt requested

16.7 Headings

The section headings in these Terms are for convenience only and have no legal or contractual effect.

16.8 Language

These Terms are written in English. Any translations are provided for convenience only. In the event of any conflict between the English version and a translated version, the English version shall prevail.

16.9 Export Control

The App may be subject to U.S. export control laws and regulations. You agree to comply with all applicable export and re-export restrictions and regulations and will not transfer the App to a prohibited country or person.

16.10 U.S. Government Rights

If you are a U.S. government entity, the App is a "commercial item" as defined in 48 C.F.R. §2.101, and is provided with only those rights as are granted to all other end users under these Terms.

18. PLATFORM INTERMEDIARY DISCLAIMER

Qaswa Connect is a technology platform that facilitates connections between users and masjids. We are not a masjid, religious organization, charity, financial institution, or religious authority.

We do not:

  • Operate, manage, or control any masjid listed on the platform

  • Endorse, verify, or guarantee the religious teachings, practices, or legitimacy of any masjid

  • Provide religious guidance, rulings (fatwas), or spiritual advice of any kind

  • Guarantee the accuracy of prayer times, event information, or any content posted by masjids

  • Act as an employer, agent, or representative of any masjid or its staff

  • Assume responsibility for the actions, omissions, or conduct of any masjid, its administrators, or its community members

Each masjid on the platform is an independent entity solely responsible for its own operations, content, and compliance with applicable laws. Any disputes between you and a masjid must be resolved directly with that masjid. Qaswa Connect is not a party to any agreement between you and any masjid.

19. DONATION INTERMEDIARY DISCLAIMER

Qaswa Connect acts solely as a technology intermediary that facilitates donation transactions between donors and masjids. We are not a charity, nonprofit organization, or financial advisor.

Important disclaimers regarding donations:

  • We do not solicit donations on behalf of any masjid; masjids independently manage their own fundraising

  • We do not hold, invest, or manage donated funds; all donations are processed directly through Stripe to the masjid's connected account

  • We do not verify, audit, or guarantee how masjids use donated funds

  • We do not guarantee the tax-exempt status of any masjid; donors are solely responsible for verifying tax deductibility with a qualified tax professional

  • The email receipts we provide (as described in Section 5.5) are transaction confirmations for your personal record-keeping purposes only; they are not tax receipts or certificates of charitable deduction. Donors should consult a qualified tax professional to determine the deductibility of any donation and should obtain official documentation directly from the masjid if required for tax purposes

  • We are not responsible for any financial loss arising from donations made through the platform

Donors acknowledge that they make donations voluntarily and at their own risk. Qaswa Connect shall not be liable for any misuse, misallocation, or misrepresentation of funds by any masjid.

20. RELIGIOUS CONTENT DISCLAIMER

The App may contain or facilitate access to religious content, including but not limited to khutbahs (sermons), Islamic educational materials, prayer times, Ramadan schedules, and community discussions on religious topics.

Qaswa Connect does not provide, endorse, verify, or take responsibility for any religious content, teachings, interpretations, or advice shared through the App. All religious content is provided by individual masjids, their administrators, or community members and represents their own views and interpretations.

You should not rely on any content in the App as a substitute for consultation with qualified religious scholars, imams, or other religious authorities. Qaswa Connect expressly disclaims any liability arising from reliance on religious content shared through the App.

21. MASJID VERIFICATION DISCLAIMER

While Qaswa Connect implements a verification process for masjids registering on the platform, this verification is limited to confirming basic identity and organizational information. Our verification process:

  • Does NOT constitute an endorsement of any masjid's religious teachings, practices, or leadership

  • Does NOT guarantee the financial integrity, solvency, or fiscal responsibility of any masjid

  • Does NOT verify ongoing compliance with tax-exempt status requirements

  • Does NOT guarantee the safety or security of any physical masjid location

  • Does NOT create any fiduciary duty, partnership, or agency relationship between Qaswa Connect and any masjid

Users should exercise their own judgment and due diligence when interacting with masjids through the platform.

22. ASSUMPTION OF RISK

You acknowledge and agree that your use of the App and participation in any activities facilitated through the App (including but not limited to attending events, volunteering, making donations, and communicating with other users) is entirely at your own risk.

Without limiting the foregoing, you assume all risks associated with:

  • Attending events or gatherings organized by masjids through the App

  • Interacting with other users, masjid administrators, or community members

  • Making financial contributions or donations to masjids

  • Volunteering for activities organized through the App

  • Relying on information, content, or advice shared through the App

  • Sharing personal information with other users or masjids

Qaswa Connect is not responsible for the conduct of any user, masjid, or third party, whether online or offline.

23. ELECTRONIC COMMUNICATIONS CONSENT

By creating an account, you consent to receive electronic communications from Qaswa Connect, including but not limited to:

  • Account-related emails (verification, password reset, security alerts)

  • Transaction confirmations and donation receipts

  • Push notifications (prayer times, events, announcements)

  • Service updates and policy changes

  • Marketing and promotional communications (you may opt out)

You agree that all agreements, notices, disclosures, and other communications we provide to you electronically satisfy any legal requirement that such communications be in writing. You may withdraw consent to receive marketing communications at any time through the App settings or by clicking "unsubscribe" in any email, but you cannot opt out of transactional or legal communications while maintaining an active account.

24. ANTI-MONEY LAUNDERING AND FINANCIAL COMPLIANCE

Qaswa Connect is committed to complying with all applicable anti-money laundering (AML), counter-terrorism financing (CTF), and sanctions laws and regulations. We reserve the right to:

  • Monitor transactions for suspicious activity

  • Report suspicious transactions to relevant authorities as required by law

  • Refuse, suspend, or reverse any transaction that we reasonably believe may violate applicable laws

  • Request additional identification or documentation from users or masjids

  • Suspend or terminate accounts associated with suspected illegal activity

  • Cooperate with law enforcement investigations

You represent and warrant that your use of the App and any donations you make are not for the purpose of money laundering, terrorism financing, or any other illegal activity.

25. STATUTE OF LIMITATIONS

YOU AGREE THAT ANY CLAIM OR CAUSE OF ACTION ARISING OUT OF OR RELATED TO YOUR USE OF THE APP OR THESE TERMS MUST BE FILED WITHIN ONE (1) YEAR AFTER SUCH CLAIM OR CAUSE OF ACTION AROSE, OR BE FOREVER BARRED. This limitation applies regardless of the form of action, whether in contract, tort, strict liability, or otherwise. This provision does not apply where prohibited by applicable law.

26. RELATIONSHIP OF THE PARTIES

Nothing in these Terms shall be construed to create a joint venture, partnership, employment, or agency relationship between you and Qaswa Connect, or between any masjid and Qaswa Connect. Neither party has the authority to bind the other or to incur any obligation on behalf of the other.

27. ACKNOWLEDGMENT AND CONSENT

BY CLICKING "I AGREE," CREATING AN ACCOUNT, OR USING THE APP, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS OF SERVICE AND OUR PRIVACY POLICY. YOU FURTHER ACKNOWLEDGE THAT THESE TERMS CONTAIN IMPORTANT PROVISIONS INCLUDING A BINDING ARBITRATION CLAUSE, CLASS ACTION WAIVER, JURY TRIAL WAIVER, LIMITATION OF LIABILITY, ASSUMPTION OF RISK, AND STATUTE OF LIMITATIONS. IF YOU DO NOT AGREE, YOU MUST NOT USE THE APP.
